1. Operator & Applicability

The 4xlust.com website operated by CU Global Resource Limited (HK Company No. 3312254), registered at Flat 2304, 23/F Ho King Commercial Centre, Mong Kok, Hong Kong.

For the avoidance of doubt any reference to “4xLust”, “us” “we” or “our” in these Terms refers to CU Global Resource Limited and any reference to “you” or “your” refers to the visitor and/or user of a 4xLust website and/or purchaser of a 4xLust product from a 4xLust website.

It is a condition of a user accessing and using a 4xLust website, including all interactive features, chatbots, widgets, blogs, social networks and social network pages, the 4xLust Pleasure Guide, and other online or wireless offerings (the “Website(s)”) that 4xLust disclaims all warranties in respect of the same whether express or implied in relation to the material published on the Website. Your statutory rights as a consumer are not affected.

4xLust has fraud prevention software services that we use in order to prevent fraudulent purchases and practices; these are in place to protect both the customer and 4xLust.

4xLust provides the Website on an ‘as is’ basis and, to the extent legally possible, without warranties, representations or guarantees of any kind, express or implied, and does not warrant that the functions contained in and the material on the Website will be uninterrupted, error or defect free, that any defects will be identified or corrected, or that the Website or the server that makes it available are free of viruses or bugs. Further 4xLust does not represent the full functionality, accuracy, reliability of the materials on the Website.

In addition, and to the extent legally permissible, 4xLust makes no (and disclaims all) representations or warranties of any kind, express of implied, with respect to the Website or the information or content included on it, including any implied warranties of merchantability, title, fitness for a particular purpose or non-infringement. This disclaimer does not affect your statutory rights in relation to the provision of goods.

Notwithstanding any reference to “health advice” on the Website, nothing on the Website is intended to provide medical diagnosis, medical care, or be considered a replacement for medical advice.

11. Submitting reviews, forum messages and photographs to 4xLust

These Terms govern your conduct associated with the reviews and ratings, forums and photographs submitted to the Website. To the extent of any conflict between the 4xLust Privacy Policy and these Terms, these Terms shall prevail in particular with respect to the submission of reviews and ratings, forums and photographs submitted to the Website.

In order to submit content to the Website, you must set up an account (including establishing a login ID and password). You must ensure that the details provided by you on registration or at any time are correct and complete. Please inform us of any changes to your information by updating your personal details to ensure that our records are correct. You are entirely responsible for maintaining the confidentiality of your account information, including your login ID and password, and for any and all activity that occurs under your account or login ID. You agree to notify 4xLust immediately upon learning of any unauthorized access or use of your account, login ID, or password or any other unauthorized access or breach of security. However, you may be held liable for losses incurred by 4xLust or any other person or entity due to another person using your account, login ID, or password. We reserve the right to suspend or terminate, with or without notice, your account in the event that you breach these Terms or in case of a security issue.

By submitting any content to the Website, you represent and warrant that:

You are the sole author of the intellectual property rights thereto:

1. all “moral rights” that you have in such content have been voluntarily waived by you.

5. for which you were compensated or granted any consideration by any third party.
6. that includes any information that references other websites, addresses, email addresses, contact information or phone numbers.
7. that contains any computer viruses, worms or other potentially damaging computer programs or files.
8. that contains any images or descriptions of persons below the age of 18.

You agree to indemnify and hold 4xLust and its officers, directors, agents, subsidiaries, affiliates, joint ventures, employees and third-party service providers, including but not limited to Trust Pilot, harmless from all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown including reasonable attorneys’ fees, arising out of a breach of your representations and warranties set forth above, content or information that you submit, post to, or transmit to the Website, or your violation of these Terms, any law or the rights of a third party. You also agree to reimburse 4xLust for any cost or expense 4xLust incurs (including fees or costs of professional advisors and other experts incurred in connection with the defense or settlement of the foregoing) because of your use of the Website for any unlawful or prohibited purpose. For any content that you submit, you grant 4xLust a perpetual, irrevocable, royalty-free, transferable right and license to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or sell and/or distribute such content and/or incorporate such content into any form, medium or technology throughout the world without compensation to you.

All content that you submit may be used at 4xLust’s sole discretion. 4xLust reserves the right to change, condense or delete any content on the Websites that 4xLust deems, in its sole discretion, to violate the content guidelines or any other provision of these Terms. 4xLust does not guarantee that you will have any recourse through the Website to edit or delete any content you have submitted. Ratings and written comments are generally posted within two to four business days. However, 4xLust reserves the right to remove or to refuse to post any submission for any reason.

You acknowledge that you, not 4xLust, are solely responsible for the contents of your submission, which must comply with these Terms. Any content that you submit is done at your own risk and without any expectation of privacy. None of the content that you submit shall be subject to any obligation of confidence on the part of 4xLust, its agents, subsidiaries, affiliates, partners or third-party service providers and their respective directors, officers and employees.

By submitting your email address in connection with your rating and review, you agree that 4xLust and its third-party service providers may use your email address to contact you about the status of your review and for other administrative purposes.

As a convenience for 4xLust customers, our website includes links to other websites or material which are beyond our control. 4xLust is not responsible for the availability, accuracy, content or any other aspect of external websites linked on the Websites and does not endorse the linked websites.

13. Jurisdiction

These Terms are governed by the local laws of such 4xLust entity that is operating the respective Website excluding conflict of law rules.

14. Force Majeure

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by a force majeure event. A force majeure event which means any act or event beyond our reasonable control such as, but not limited to, strikes or industrial action by third parties (but not those caused by 4xLust’s own employees), civil commotion, riot, invasion, terrorist attacks, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic or other natural disaster (“Event”).

If an Event takes place that affects the performance of our obligations under a contract:

(a) we will contact you as soon as reasonably possible to notify you; and

(b) our obligations under a contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event. Where the Event affects our delivery of products to you, we will arrange a new delivery date with you after the Event is over.

You may cancel a contract affected by an Event. To cancel please contact our customer services team. If you opt to cancel, you will have to return (at our cost) any relevant products you have already received and we will refund the price you have paid, including any delivery charges.

15. Additional terms

We may transfer our rights and obligations under a contract to another person, but this will not affect your rights or our obligations under these Terms.

You may only transfer your rights or your obligations under these Terms to another person if 4xLust agrees in writing. These Terms are agreed between you and us. No other person shall have any rights to enforce any of its Terms.

Each of the clauses within these Terms operates separately. If any court or relevant authority decides that any of the clauses are unlawful or unenforceable, then the remaining paragraphs will remain in full force and effect.

The failure or delay of 4xLust to exercise any right, power or remedy provided under these Terms or otherwise available in respect hereof at law or in equity shall not constitute a waiver by 4xLust of its right to exercise any such or other right, power or remedy or to demand such compliance, or you of your obligations under these Terms. In the event we do waive a default we will do so in writing on a case-by-case basis.
